Sometimes called: a "Certificate of No Record" or a "Certificate de Coutume" or a "Certificate of No Impediment" or a "Certificate of Nulla Osta" or a 'Single Status Statutory Declaration" or a "Certificate of Legal Capacity to Contract Marriage" or a"Single Status Certificate" this is a declaration of origin of your freedom to marry. Almost all countries require that a couple can provide such a certificate before they will issue a marriage licence.

No standard 'Certificate of Freedom to Marry' document exists in the United States. You can however make a sworn affidavit testifying to your freedom to marry, which will be accepted in almost all countries.

In the past, the U.S. Embassy allowed American citizens to swear such an affidavit of eligibility to marry before a U.S. consular officer. The Embassy discontinued this practice several years ago, however, because local officials were interpreting these documents as meaning that the Embassy had actually verified the content of the citizens statements, when in fact the consular officer was merely attesting to the fact that the individual in question had made the statement.


This Certificate is issued upon request to be used as proof of unmarried status when getting married in a foreign country.

The Certificate is issued solely upon the sworn statement of the applicant, with no liability for the information assumed by the Office of the City Clerk. The applicant must appear in person in the Clerk office and provide acceptable proof of identification in order to obtain the certificate.

In order to obtain a Certificate of non-impediment the applicant must reside within the city. The Certificate of Non-Impediment is valid for six months from the issuance date. The applicant must provide the following information: Future spouse's full name, Town / City and Country where the ceremony is to be performed, A ceremony date / month / within the six month period of the certificate being issued

A Single Status Affidavit also known as single/non-marital status certificate is a sworn statement that you are eligible to marry. Affidavit of Single Status, signed before a notary public.
Different countries can requireddifferent form of Affidavitof single status. Then has to be Certified by the Secretary of the State Office of the state where the document is executed (Apostille of Certification for non-Hague countries). Some states require the notarized document to be sent to the notary public's county clerk for verification before presenting to the Office of Secretary of State.
Together with the Affidavit of Single Status the divorced or the widowed shall have the divorce certificate or death certificate of the ex-spouse be certified/authenticated.
